Frogwares has published yesterday a lengthy post in which it accuses NACON, its former publisher, of cracking and pirating The Sinking City. On the other hand, NACON accuses Frogwares of not respecting their contract.
Let’s start from the beginning. On February 26th, NACON published a new version of The Sinking City on Steam. According to Frogwares, the publisher has pirated and cracked a version of the game from Gamesplanet.
As Frogwares claimed:
“In order to make changes Nacon had only one way: to decompile or hack the game using a secret key created by Frogwares since the totality of the game’s content is archived with an Epic Unreal Engine encryption system.
To be clear this is hacking and when hacking has the purpose to steal a product and make money with it, it’s called piracy or counterfeiting. In order to achieve this goal, programmers with serious skills need to be involved. This is not DIY work by inexperienced people, this is done by programmers who know Unreal engine well.”

On the other hand, NACON issued the following statement. According to the publisher, it has every right to release The Sinking City on Steam (at least for now). While there is a legal battle between NACON and Frogwares, the courts have already given the green light to NACON to publish The Sinking City on digital stores.
“For the release of The Sinking City on Steam, published by Nacon, Frogwares posted on Twitter urging players not to buy it. We regret that Frogwares persists in disrupting the release of the Sinking City. It was Frogwares who came to Nacon to request financing for the development of the game, and to date, more than 10 million euros have been paid to Frogwares by Nacon. It was Frogwares that relied on our marketing and promotion teams, representing thousands of hours of work and several million euros worth of investment. Now that the game has been fully developed, and published, largely thanks to Nacon’s money and work, Frogwares would like to revise the terms of the contract to their sole advantage. It’s easy to play the victim, but all we seek is that Frogwares respect its commitments both in the contract and as demanded by the courts.”

One thief stealing from another thief. pfffft… Frogwares Kept me from having a DRM-Free copy of this game Via GoG (with their epic exclusivity GREED), Nacon Robinhood’d the game and made it available for all to play. The cries of a con man after he’s victimized by another con-man. I hope you all destroy each other in court.

You didn’t read Frogware’s report. Nacon didn’t made the game available for all to play like seeding on a torrent or something. They grabbed a copy from Gamesplanet, reverse engineered it in order to show their name in the intros and main menu. In order to decrypt the game files to carry out those tasks they used illicit means and also while at it removed some menu options and also failed to apply certification to the exe file as well.
About Epic exclusivity, it was the publisher Nacon’s decision as well.
they had every right to do that, they funded this game. they should sue frogware.

Oh? News flash: there are always two sides to a story. When there is a dispute, it is not uncommon for both sides to have a different version of the same story. Have you not seen any court case on tv or in real life?
In the court papers, Nacon said they paid Frogware over 10 million euros…
And about exclusivity, you got it all wrong. Notice how Frogware and Nacon did not have any conflict more than a year ago when it was decided to publish the game on Epic. Or why do you think Frogware put the game on EA Origin? Or is selling a version (available on Gamesplanet) which uses their own launcher? And who is telling everyone now not to purchase the only version of the game, now available on Steam? Make no mistake, this is all about some sweet exclusivity money that Frogware feels they are missing out on. They don’t care about consumers or the game being available on more platforms like Steam or GoG. The dispute is about Frogware being greedy.

Which is the version to pirate? (no links, of course) I want to see for myself if it even is worth playing, but no way I’m giving a cent to any of these greedy drama queens.
