Nintendo is suing the creators of the Nintendo Switch emulator, Yuzu

Nintendo has sued the creators of the Yuzu emulator. According to the big “N”, the emulator breaks their game protection and helps with piracy. To be honest, this is quite laughable. But no, this isn’t an out-of-season April’s Fools joke. Nintendo has indeed taken legal action against them.

Nintendo seeks damages for alleged violations and a shutdown of the emulator. And if the big “N” wins this case, this could be catastrophic for the console emulation scene.

And look. I get it. Nintendo is not happy with the Tears of the Kingdom leaks. However, this has nothing to do at all with Yuzu. Nintendo also claims that Yuzu’s Patreon support doubled during that time. Again, this is completely irrelevant.

To be honest, this feels like a nothing-burger and an easy win for the Yuzu team. And I seriously hope the team fights back. Not only that but Nintendo specifically targeted Yuzu. Well, news flash Nintendo. Ryujinx was also able to play Tears of the Kingdom and Breath of the Wild on launch day.

Now this isn’t something new. We’ve seen a lot of companies suing the teams behind popular emulators. However, none of them have won. Hell, Take-Two even tried to sue the modders that reverse-engineered GTA 3 and GTA Vice City. And no. Take-Two did not win that case either.

As said, I really hope that the Yuzu team will fight back. This should be an easy win as the team is not distributing copyrighted content. And as for the spoilers of Tears of the Kingdom… how about you sue X/Twitter and YouTube Nintendo? Because a lot of people spoiled it in those places. So do it, you cowards.

    One of the great wonders of the world, is how this pile of cancerous s**t is still in business, and if it weren’t my firm understanding of just how colossally stupid the average human being is, it would continue to elude me.

    In a perfect world, Nintendo would have gone bankrupt, 3 decades ago.

I think the reputation is there keeping them going I’ve seen people who are not much into thinking who just buy 2-3 switches for their brood, usually the type that are impulsive when buying and such like 7-11 types. And your iphone, disney addict types are one big component to nintendonts sales also, almost cultist level transferrence of emotional needs to a company and it’s products very strange people. You can read their nonsense on joogles reddit etc And let’s not forget the very weird asian gaming culture, like ants type of thing, they can count on tens of millions of sales in japan alone, without that they would be like sega today.

    4. Wasn’t aware of the whole renting thing. Nintendo of today is a shadow of its former self but to act like they’ve been worthless since the beginning, especially all those decades ago, is disingenuous.

      I get the criticism here but just because you don’t see the value in the things they’ve offered in the past doesn’t mean they’re nothing but a hindrance for the industry. They are today, but back then Nintendo were on the top of their game and created unforgettable experiences.

      I’m sure Valve themselves have made some questionable choices in the past but they did make PC gaming relevant again. They’re also to blame for spearheading this whole digital-only era. If they were to do something like what Nintendo did I doubt anyone would be wishing for them to go bankrupt.

I hope they do but we all know the shysters cost a lot to play their little court game and the ones with all the money usually can bully little guys into compliance even if there is no case whatsoever. AFAIK yuzu clearly says the user is responsible for owning a legal copy of the game and backing it up which is legal then using that backup for emulation, they don’t provide links to roms or endorse it so there’s really no case here. Emulation is totally legal if they don’t use any of the systems code so this is just a bully seeing what it can get done by bullying.

      1. Is this a joke? We’re talking about an Orin SOC (2018 tech) rumored to be launching in 2025. When was the last time you got hyped about 7 year old tech? The Switch 2 will be further behind technologically than the Switch 1 was when it launched.

        1. I thought it was supposed to be roughly the same power as a RTX2050. Its no powerhouse but with DLSS and frame generation on a handheld that’ll be a fraction of the price of most of its competition itll be something pretty interesting.

          1. It’ll definitely be a huge jump over the existing switch but they quite literally are further behind from a technology standpoint than the switch was back in 2017. You have to keep in mind that once it releases in 2025 the PS6/xbox?? will probably only be a year or two away.

          2. You’re not wrong. I guess we’ll have to see how far gaming advances in design and tech in that space. I think switch being on a mobile chip instead of what seems to be now an actual cut down discrete gpu with similar architecture to a more modern flagship will allow it to age similarly well.

        2. Well let me put it this way, id rather my game look like they are from the ps3/ps4 era than the psx or ps2 era and ps5 has yet to wow me with graphics or games.

          1. Broadly speaking I’d say a lot of switch ports were already on par with the PS3 era, stuff like LA Noire looked extremely close. Some of the more ambitious ports had to run at insanely low resolutions but I don’t see them abandoning that method once the switch 2 releases, especially since the rumor is they’ll rely heavily on DLSS 2.

    1. If you sue the developers working on such projects into poverty, then eventually no one will be brave enough to try to make emulators. At least not without taking them underground and distributing them only via torrents, however once that happens Nintendo will have succeeded in making sure that most gamers don’t use emulators.

        -Sony fired 8% of their gaming division today, 900 employees. While Sony’s gaming division looked healthy on the surface, the Sony leaks showed otherwise, with massive development costs for their exclusives and razor thin margins.

        -Nintendo is increasingly under threat from PC handhelds. They are also under threat from 3rd party indie developers they have no control over. We are starting to see some major indie developers not releasing on Switch anymore. This was unthinkable just a few years ago, you had to be on Switch. Now they have options on PC, India is the gaming market seeing the biggest growth, and these are almost all PC gamers.

        So you have 2 Japanese companies left, trying to hold on for dear life with exclusives, aggressive DRM and lawsuits. Selling consoles that are basically just locked down PC which makes emulation super easy. They are now in the same situation Sega was in.

Unity and Game Maker have democratized game development. We are starting to see some major indie developers not releasing on Switch anymore. This was unthinkable just a few years ago, you had to be on Switch. Now they have options on PC, India is the gaming market seeing the biggest growth, and these are almost all PC gamers.

        3. Microsoft went “all platform” with 4 titles. Only 4. And none of them were modern popular titles. Just the rumor of Microsoft releasing their exclusives on other platforms caused some of their most loyal fans and influencers to threaten to abandon ship. Microsoft can’t afford to release their new exclusives on non-Microsoft platforms, at least not until they can get their fanbase used to the idea.

          Sony has been releasing things on PC due to the rising popularity of PC gaming and the increased profits of selling there, but I doubt they will make their new games for Xbox as well. They rely on sales through their own marketplace for increased revenue on game sales.

          Nintendo doesn’t care about any platforms but their own. They are stubborn, foolish, and altogether evil. Combine that with the fact that any new hardware device they release, regardless of how bad it is, automatically sells like hotcakes and Nintendo will probably never care about selling games outside of their own ecosystem. Also it seems like no matter how evil Nintendo is gamers won’t boycott them, so their game sales for their platforms are guaranteed, and they will never have any need to release on other platforms.

  17. I bought a hard copy of Tears of the Kingdom ONLY because I could emulate it on PC. There was no way I was going to play it at (under) 30 fps at horribly low resolution. I would have also bought it on PC had that been an option.

    1. This was me with Fire Emblem Engage. Turn based game chugging at barely 20fps on launch was mind boggling. Then I learned how to dump it and had a blast over the summer. I’d do the same with Pokemon but I dont want to fragment my guys.

  19. Why buy a Nintendo Switch, when you can buy a PC handheld instead, that can run any PC game, and can emulate Nintendo games for free.

    Nintendo can’t answer this question, they are in a really bad situation they created themselves. PC indie developers are making money selling games on PC handhelds, Nintendo is not. Those indie developers need Nintendo less and less.

    Nintendo and Sony their whole business model is exclusives and locking down platforms. PC handhelds and Microsoft are saying exclusives no longer matter, and are taking the sledgehammer to that business model.

    Why buy a Switch when you can buy this:

    I don’t remember well really, but which Nintendo emulator was it that used some “stolen keys” to work for some games? I think they also replaced that method for something else, or said they would?

  21. Nintendo is not as sure to win this since emulators themselves are perfectly legal.

    Secondly, this is an open source project that many anonymous people worked on. Nintendo will have a very difficult time convincing a judge that specific individuals are responsible for any claims.

  23. I don’t have a good opinion of Nintendo and their business practices but it’s obvious that they will be successful financially anyway. At least for the foreseeable future. Year after year they post large profits. Here are the top 5 best selling consoles of all time:

    PlayStation 2 – 159 million

    Nintendo DS – 154.02 million

    Nintendo Switch – 139.36 million

    Game Boy/Game Boy Color – 118.69 million

    PlayStation 4 – 117.2 million

    Nintendo has reported that around 1.2 billion games have been sold for the Switch. Mario Kart 8 Deluxe alone sold 61 million copies so far. There must be a massive amount of people loyal to Nintendo no matter what they do.

  24. You are wrong about the easy win part because you don’t really understand how this works while I have first hand experience with a large corporation stealing my patent.

    Nintendo has a large team of lawyers on retainer and Yuzu will be lucky to come up with more than one. The Discovery process alone could cost them upwards of $100,000. (Not to mention their lawyers are going to come to your house, business and other property and comb through every aspect of your life)Thus it doesn’t matter if you could win legally because you can’t afford to fight them it can easily cost millions. The very best they can hope for is to shut it down and get away without having to pay anything to Nintendo. The worst would be having to shut it down and owe Nintendo possibly millions (In my case I was more or less forced to sell my patent for 10 cents on the dollar of it’s actual worth and they paid my legal fees)

    Nintendo is simply too big to lose and this will never see the courtroom

    1. Not true. Litigation does not serve as a platform for showcasing wealth. Moreover, who told you that it costs millions? Such expenses may be incurred in cases involving homicide, where trials are protracted and subsequent appeals are made, thereby elongating the legal process.

  27. Nintendo is unlikely to win this since emulators themselves are perfectly legal. Yuzu never distributed keys or ROMs themselves.

    Secondly, this is an open source project that many anonymous people worked on. The idea that a judge would order Microsoft to help identify those people who contributed to this Github project is very far fetched.

    This just shows how desperate Nintendo is. If Nintendo loses and a judge affirms the legality of Switch emulators, Nintendo will be in a lot more trouble than before they started the lawsuit.

    1. We all can only hope that this will indeed be the final outcome, but the sad truth is that without strong financial support, you are at a clear disadvantage, especially so in the courts of the USA.

      Linux as the largest & most important open-source project in the world is lucky enough to have the backing of the world’s wealthiest companies, including Microsoft, thus absolutely no one tries to mess with it anymore like some patent trolls tried to do in the past.
